Email Server

TCP port 25 at jcb-sc.com and at any lower-level domain names is the port for the SMTP server at this site.

By connecting to this SMTP server, if you either disconnect prior to receiving the entire greeting or respond to the greeting by issuing any command other than QUIT, you accept and agree to abide by the rules, guidelines, policies, terms and conditions of this web site, as stated below. James Craig Burley reserves the right to change the terms of this site at any time.

Any transmission or receipt of network packets to or from this system's port 25 (SMTP) and your system is considered to constitute a portion of one or more SMTP sessions. You are considered, along with any computing device (such as hardware or software) employed to transmit, receive, and monitor packets pertaining to an SMTP session, to constitute an SMTP client.

Server Access

You will not attempt to exploit security holes, bugs, configuration problems, or other errors on the SMTP server.

Privacy Policy

The contents of any SMTP session may be recorded, transcribed, studied, and/or used for civil or criminal proceedings, entirely at the discretion of the owner or System Administrator for this site.

Summaries of characteristics of any SMTP session may be made public, e.g. via a web site, a Run-Time-Blocking (RBL) list, and so on, entirely at the discretion of the System Administrator of this SMTP server. Such summaries may include your IP address, any and all related host names, other publically-available information on you and on any computing devices (hardware or software) you are using in conjunction with your Internet connectivity, and any other information deemed by the System Administrator to be helpful to others in determining whether you are sending network packets to their system and whether and how to respond to such packets.

Transmissions to Server

You will not transmit false, forged, or substantially misleading envelope sender (MAIL FROM) or recipient (RCPT TO) information via an SMTP session, except in cases where you are doing so solely as a component of an automated Mail Transfer Agent (MTA) relaying or queueing email in substantially full compliance with pertinent Internet standards, RFCs, and practices, including providing working postmaster and abuse email addresses.

You will not transmit any of the following material to the SMTP server, except in cases where you are doing so solely as a component of an automated double-opt-in list manager to which an authorized user of this system has subscribed and is easily able to unsubscribe:

You will not employ any means to obfuscate the contents of an SMTP session, where such obfuscation is designed to foil attempts by "spam-detection" and/or "virus-detection" software, unless the email includes the header Precedence: junk.

You will pay the owner of this SMTP server $1 per violation of each and any occurrence of the above, plus $100 per written communication sent by same owner to obtain payment, plus reasonable attorney's and court fees used by same owner to obtain payment.

You will use either your SMTP client's correct Internet IP address or its Fully Qualified Domain Name (FQDN) in any HELO or EHLO command your client issues during the SMTP session.

Upon receiving a successful report or a permanent rejection indication from the SMTP server in response to transmission of an email, you will not attempt further automated deliveries of that message via email, though this prohibition does not apply to attempts to deliver the same message via other means to ensure or confirm its ultimate receipt.

Your use of any "spam trap" email addresses on this system for envelope sender or recipients, or elsewhere in the headers of email you transmit, may be treated as persuasive evidence that you are making unauthorized use of this system and of these addresses.

Responsibilities and Behavior of Server

The SMTP server may, entirely at the discretion of its System Administrator, refuse or ignore any given incoming TCP connection; drop the TCP connection for an SMTP session at any time; take any amount of time to deliver any response to an SMTP client; and respond to an SMTP client in any way it chooses. It is the responsibility of you and your SMTP client to protect your system from refused, ignored, dropped, delayed, or non-SMTP-conforming TCP connections when they are made to this SMTP server.

The SMTP server does not and cannot guarantee delivery of any email message or of delivery status notifications (DSNs) pertaining to any email message. Any report of successful receipt of an email message by this SMTP server constitutes nothing more than a suggestion that you are no longer responsible for delivery of that particular instance of that message via email.

Responsibilities and Behavior of System Administrator

No "spam trap" email addresses on this system need to be disclosed in order to establish whether a given email is an Unsolicited Bulk or Commercial Email (UBE or UCE) or a virus, worm, or trojan horse. You will not request, demand, or cause to be requested or demanded, such disclosure in any legal proceeding or in any communication.

You will raise any objections you have regarding the behavior of the owner and/or System Administrator of this SMTP server, or of the SMTP server itself, first to the postmaster for this server via email, second via certified letter sent through the Postal Service to the owner of this SMTP server (as listed in the WHOIS data base). You will ensure that each such communication clearly and unamibiguously identifies the nature and source of each objection or concern you have, specifies the range of responses you desire, and specifies any and all alternate courses of actions you are prepared to take in the event you achieve none of those responses. You will clearly identify yourself, your business name and address if any, and your personal address, in any such communication.
